Terms of Use

These Terms of Use (the “Terms”) govern your access to and use of gemmr.com and any service we provide (collectively, the “Service”). The Service is operated by Gemmr (“Gemmr,” “we,” “us,” or “our”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Gemmr is

Gemmr provides artificial-intelligence-based pre-grading predictions for trading cards. You upload images of a card; we return predicted grades (across grading services such as PSA, BGS, CGC, SGC, and TAG), sub-grade breakdowns, and a recommendation. Gemmr is an estimation tool. Gemmr is not a grading company, is not affiliated with PSA, BGS, CGC, SGC, TAG, or any other grading service, and our predictions are not certifications.

2. Eligibility and account

You must be at least 13 years old to use the Service. If you are between 13 and 18, you must have permission from a parent or legal guardian. By creating an account you represent that you meet these requirements.

You are responsible for the security of your account credentials and for all activity that occurs under your account. Notify us promptly at hello@gemmr.com if you suspect unauthorized access. You agree to provide accurate registration information and to keep it current.

You may not create an account using false information, impersonate another person, or maintain more than one account except with our prior written permission. We may suspend or terminate accounts that violate these requirements.

3. Grading predictions are estimates — read this

The grades Gemmr predicts are estimates produced by an AI model. They are based on the images you upload, photo quality, lighting, angle, and the model’s pattern recognition. They are not guaranteed to match what a grading service would assign your card.

Real grading services use trained human graders, calibrated lighting environments, and physical inspection. Gemmr cannot replicate that. Differences of a full grade or more between Gemmr’s prediction and a real grading service’s assignment are possible and should be expected as a normal range, not an error.

Do not rely on Gemmr’s predictions as the sole basis for any financial decision, including but not limited to: buying or selling a card, submitting a card for grading, valuing a collection, or determining insurance coverage. You assume all risk associated with such decisions.

4. Your content and ownership

You retain all ownership rights in the images of cards you upload (“Your Content”). By uploading Your Content, you grant Gemmr a worldwide, non-exclusive, royalty-free license to host, store, process, and display Your Content for the purpose of operating the Service, including sending it to third-party AI providers for grading inference and displaying it on your profile or scan pages (subject to your privacy settings).

You represent and warrant that you own or have the right to upload Your Content, and that Your Content does not infringe any third party’s rights or violate any law.

You may delete individual scans at any time. Deletion removes Your Content from active storage promptly; see our Privacy Policy for information about backups.

5. Public profiles and shared content

By default, your profile and scans are private. You may choose to make your profile or individual scans public. When you make content public, you understand and agree that:

  • Anyone visiting the relevant URL can view that content
  • Public content may be indexed by search engines
  • Other users may share links to your public content
  • You can change content back to private, but cached or shared copies may persist temporarily on third-party services

6. Acceptable use

You agree not to:

  • Upload images that are not photos of trading cards intended for grading prediction
  • Upload images containing nudity, sexually explicit content, violence, hate symbols, illegal content, or content depicting minors in any inappropriate context
  • Use the Service to harass, threaten, defame, or impersonate any person or entity
  • Scrape, mass-download, or use automated means to access the Service except as expressly permitted
  • Reverse-engineer the Service, attempt to extract prompts or model weights, or attempt to bypass rate limits, quotas, or access controls
  • Attempt to gain unauthorized access to any account, system, or data
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service to develop or train a competing product or AI model
  • Use the Service in violation of any applicable law or regulation

We may remove content, suspend accounts, or terminate access for violations of this section at our sole discretion, with or without notice.

7. Gems, plans, and credits

The Service uses a virtual currency called “Gems” that you spend to use various features. Plans include monthly Gem allotments; you may also purchase Gem packs. Gems and packs have no cash value, are not redeemable for currency, and are not transferable between accounts.

Monthly Gem allotments are not cumulative and expire at the end of each billing period unless otherwise specified. Pack Gems do not expire. We reserve the right to change Gem costs for features at any time with reasonable notice.

When payment functionality is enabled: subscriptions renew automatically until canceled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable.

8. Beta service, accuracy, and changes

The Service is provided on an evolving basis. Features may be added, changed, or removed at any time. AI grading models are updated periodically; predictions for the same card may change between updates. We do not guarantee that predictions are accurate, consistent over time, or appropriate for any particular purpose.

We may, in our sole discretion, change these Terms, our pricing, or the operation of the Service at any time. Material changes will be communicated via the Service or by email. Your continued use after changes constitutes acceptance.

9. Third-party services and links

The Service may link to or integrate with third-party services (for example, Google or Discord for sign-in, Stripe for payments, or external grading services for cert lookup). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services and disclaim any liability arising from them.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. To the maximum extent permitted by law, Gemmr disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.

Without limiting the foregoing, Gemmr makes no warranty that grading predictions will match grades assigned by any grading service, that the Service will be free of errors, that defects will be corrected, or that the Service or the servers that make it available are free of harmful components.

11. Limitation of liability

To the maximum extent permitted by law, in no event will Gemmr or its officers, employees, affiliates, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, lost revenue, lost data, business interruption, or financial losses arising out of any card purchase, sale, grading submission, or other transaction influenced by use of the Service, whether based in contract, tort, strict liability, or any other theory, even if we have been advised of the possibility of such damages.

Our total liability to you for all claims arising out of or related to the Service will not exceed the greater of (a) the amount you paid to Gemmr in the twelve months preceding the event giving rise to the claim or (b) one hundred U.S. dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, the above limitations apply to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Gemmr and its officers, employees, affiliates, agents, suppliers, and licensors from and against any claim, loss, damage, liability, cost, or expense (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service, (b) Your Content, (c) your violation of these Terms, or (d) your violation of any law or any right of a third party.

13. Termination

You may terminate your account at any time by emailing hello@gemmr.com. We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, if your account has been inactive for an extended period, or if continued operation poses a security, legal, or operational risk.

Upon termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.

Before filing a formal dispute, you agree to first contact us at hello@gemmr.com and attempt in good faith to resolve the issue.

15. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gemmr regarding the Service and supersede any prior agreements. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign them freely.
